The Short Answer

Ontario requires ATVs and UTVs operated on public land or trail systems to carry a minimum of $200,000 in third-party liability insurance, though $1,000,000 is generally recommended. Your cottage policy typically only covers a parked ATV for theft or fire, not liability or damage while riding. A dedicated off-road vehicle policy is needed for operational coverage on trails and Crown land.

ATVs and side-by-sides (UTVs) are increasingly common at Ontario cottages. Whether you use yours for trail riding, property maintenance, or exploring the Crown land behind the lake, it’s important to understand how Ontario insurance and licensing rules apply — and where your coverage gaps might be.

Ontario’s Off-Road Vehicles Act

In Ontario, ATVs and UTVs are regulated under the Off-Road Vehicles Act (ORVA). Under this legislation, off-road vehicles operated on Crown land, road allowances, or designated trail systems must be registered and carry a minimum level of insurance.

The minimum liability requirement for an off-road vehicle operated outside private property in Ontario is generally $200,000 in third-party liability. However, as with snowmobiles, most insurance professionals recommend carrying $1,000,000 or more, given the injury potential of recreational vehicle accidents.

Operating an uninsured ATV on public land or trail systems exposes you to significant personal financial liability in the event of an accident.

ATV Insurance vs. Cottage Property Coverage

A common point of confusion is whether an ATV stored at the cottage is covered under the cottage insurance policy. In most cases:

  • A parked, stored ATV at your cottage property may be covered under your contents coverage up to certain limits, but typically for theft or fire only — not for damage that occurs while the vehicle is in use.
  • Liability while operating the ATV is not covered by your cottage policy. Cottage liability coverage applies to premises liability, not vehicle operation.
  • Collision and physical damage while riding is not covered by cottage contents coverage.

This means that if you ride your ATV on a trail and roll it into a ditch, your cottage insurance provides no coverage for the repairs or for any injuries you cause to others.

Side-by-Sides and UTVs

UTVs (also called side-by-sides or SxS — brands include Can-Am Defender, Polaris Ranger, Kawasaki Teryx, and others) are increasingly popular in cottage country for their utility and passenger capacity. Insurance for UTVs is handled similarly to ATVs, but underwriting can be slightly different because of the higher speed capability and passenger exposure of some models.

If you’re shopping for a UTV, confirm with your broker that your intended insurer is familiar with the specific make and model, as some high-performance UTVs may be subject to additional underwriting scrutiny.

OFATV Trail Permits

The Ontario Federation of All Terrain Vehicle Clubs (OFATV) maintains a trail network across the province, and a trail permit is required to ride on OFATV-affiliated trails. Similar to the OFSC snowmobile system, the trail permit is not insurance — it’s a membership that supports trail maintenance and access. You still need a separate insurance policy in addition to any trail permit.

Private Property Use

If you only ever ride your ATV on your own cottage property and never cross a road, trail, or Crown land boundary, Ontario law generally does not require you to carry liability insurance for private property operation. However, you remain personally liable for any injuries or damage that occur on your property — including to guests, neighbours, or anyone else present. A dedicated off-road vehicle policy or a specific endorsement to your cottage policy may still be worth considering for private-property use.
